The Accident Compensation Conciliation Service (ACCS) are delivering significant changes to the dispute resolution process in line line with the Workplace Injury Rehabilitation and Compensation Amendment (Arbitration) Act 2021. These changes will expand WorkSafe’s dispute resolution services to include arbitration.
The new service will commence on 1 September 2022, and will be available to workers who are injured on or after this date.
How will the arbitration process worker?
If a dispute is not resolved through the ACCS process, the injured worker has the option to take the matter to arbitration.
Whilst WorkSafe advised that Arbitration is an informal process, any determination made by an Arbitrator is binding.
What does this process mean to Employer?
Arbitration will be another link in the dispute process and employers will need to ensure their Workers Compensation Agents make sustainable decisions.
